doo provides the organizers with an e-mail function, among other things for advertising events. doo attaches great importance to legally compliant e-mail marketing. In this e-mail policy, the organizers who use the e-mail function undertake to use it in accordance with the law.
doo would also like to ensure that the e-mails sent via the e-mail function have optimal deliverability. This e-mail policy regulates further obligations in this regard in order to optimize deliverability in the interest of all users of the doo event management platform.
This e-mail policy is part of the contract between the organizer and doo.
1. No spam
No spam: E-mails may only be sent via the doo event management platform if the specific sending is legally permissible. Advertising e-mails may only be sent via the doo event management platform if the addressee has expressly consented to the respective dispatch or if it is e-mail advertising as part of an existing customer relationship (according to § 7 para. 3 UWG). Declarations of consent must meet the legal requirements, be documented and verifiable. The use of the double opt-in procedure is expressly recommended for collecting consent. Proof of legality: If an e-mail sent by the organizer results in a complaint from an addressee to doo, a blacklisting with an anti-spam organization ( E.g. Spamhaus or Spamcop) or if doo receives a request from a supervisory authority or a relevant association, the organizer must provide doo with proof of the legality of the dispatch within one working day Contact option included, by means of which the addressee can revoke his consent. Revocations made via the unsubscribe function of the doo event management platform are automatically implemented by the doo event management platform. Other revocation options must not make the revocation excessively difficult, ie in particular no login must be required. Cancellations addressed directly to the organizer must be implemented by the latter within three working days. The organizer must ensure that all e-mails to the specified from and reply address are processed immediately. Up-to-dateness: e-mail addresses that have not been used by their owners for a longer period of time are sent by some free mail Providers first block and then send a rejected bounce message for a short time (usually one month). Some of these e-mail addresses are then converted into spam traps, ie if these e-mail addresses continue to be written to, the sender's IP address will be blocked. Therefore, for e-mail addresses that are to be written to via the doo event management platform, either the consent must have been given in the last two months before the first dispatch via the doo event management platform, or these addresses must be at least every two months. Bounces: Lists that are written to via the doo event management platform must be cleaned of rejected bounces. A rejected bounce is the message from the mail server that was written to that the address that was written to does not exist or is permanently deactivated. The organizer must ensure that rejected bounces have already been blocked or deleted regularly (at least every two months) in the lists he has written to via the doo event management platform before they are used via the doo event management platform. The default settings of the doo event management platform provide for an automatic blocking of non-existent and permanently deactivated e-mail addresses after the first rejected bounce. No illegal content: Every e-mail sent via the doo event management platform must meet the legal requirements in terms of form and content. In particular, every advertising e-mail must contain an imprint that meets the legal requirements. The organizer is obliged not to violate any legal regulations or the rights of third parties when using the doo event management platform, in particular (i) not to transmit any content, to save it, to link it or to refer to it in any other way is pornographic or violates youth protection laws, is implicitly or explicitly sexually suggestive, glorifies violence, violates personal rights, is threatening, insulting, harassing, slanderous, fraudulent, vulgar, obscene, hateful, left-wing or right-wing extremist in nature or which prompts or incites violations of laws, (ii) not to transmit, save, link or otherwise refer to content that infringes the rights of third parties, in particular trademark, identification and copyrights, patents, designs and utility models and trade secrets, and (iii) no harmful programs (e.g. viruses) e.g u to transmit, store, link or otherwise refer to malicious programs. Use permitted under data protection law: The e-mail function of the doo event management platform offers extensive functionalities (e.g. campaign tracking, creation of user profiles and targeting), the addressee concerned may need to be informed of their use or the express consent of the addressee concerned may be required for their use. The organizer must ensure that the various functions are used in accordance with the law with regard to the data or e-mail addresses concerned. The organizer has to compare the default settings of the doo event management platform with his requirements. Responsibility: The organizer bears the legal responsibility for all e-mails sent using the doo event management platform, including their respective content. doo is not obliged to check the legal conformity of the dispatch or the content to be sent.
2. Quality of the address listsQuality requirements:
E-mails sent via the doo event management platform should end up in the addressee's inbox and not get stuck in the spam folder or junk folder. In order to be able to guarantee the highest possible deliverability of the e-mails sent via the doo event management platform, each address list that is to be written to via the doo event management platform ("list") must meet certain quality requirements. These quality requirements are met if a shipment via the doo event management platform does not exceed the following values:

Rejected bounce: A rejected bounce is the notification from the mail server that the mail server sent that the mailed address does not exist or is permanently deactivated. If a list contains more than 5% of such inactive addresses, it can be assumed that the list has not been maintained for a long period of time. A rejected bounce rate of more than 5% will lead to a blocking or blacklisting of the affected IP addresses of the sender with most e-mail or free mail providers ("ISPs"). The rejected bounce rate is calculated based on the number of rejected bounces in relation to the total volume of a shipment.Spam Complaint: A spam complaint is the notification from an ISP that an e-mail sent via the doo event management platform was received by an addressee as " Junk” or “Spam” has been marked. A spam complaint rate of more than 0.5% will result in the affected mail being blocked by most ISPs. The spam complaint rate is calculated individually for each ISP from which doo receives notifications of spam complaints, based on the number of spam complaints in relation to the total volume of the dispatch to the respective ISP. Dispatch: The dispatch is a coherent e-mail dispatch to a distributor. List Audit: doo can, at its own discretion, examine the organizer's lists for their address quality before they are written to for the first time (“List Audit”). Should this list audit reveal that a list contains more than 10% (i) generic email addresses such as e.g. tech@domain.com, root@domain.com; (ii) so-called "disposable e-mail addresses", which are only valid for a short time and are used in particular for participation in competitions (e.g. @mytrashmail.com or @10minutemail.com); (iii) email addresses with non-existent domain identifiers (e.g. @lycos.de) (iv) technically impossible email addresses, e.g. e-mail addresses without @) and (v) e-mail addresses not permitted by the respective ISP (e.g. some providers require e-mail addresses to contain at least four characters before the @). this list is not permitted for use via the doo event management platform. Test mailing: doo can subject the organizer's address lists to a test mailing in coordination with the organizer before they are regularly written to for the first time. A test dispatch is carried out with a reduced dispatch speed to a maximum of 10% of the addresses on the list. If a violation of Section 1 and/or Section 2 of this e-mail policy is found during a test mailing, this list will not be approved for use.
3. Actions for Violations
If a shipment violates Section 1 and/or Section 2 of this e-mail policy, doo can stop the respective shipment immediately upon becoming aware of the violation. doo can, at its best discretion, block the list affected by a violation from further mailings via the doo event management platform, whereby the blocking is limited to what is necessary. A block will be waived or a block will be lifted if further violations are not to be feared. Blocking does not lead to a reduction in remuneration. If a shipment violates Section 1 and/or Section 2 of this e-mail policy, doo can only carry out further shipments at a reduced shipping speed until further violations are no longer to be feared. Further violations are not to be feared as soon as the organizer has explained in a comprehensible manner how further violations are prevented. In the event of repeated or serious violations, doo is entitled to terminate the contract extraordinarily. The organizer will replace doo for all direct and indirect damages, expenses and costs that doo a breach of legal provisions or this e-mail policy by the organizer.
